Homestead

A constitutional homestead exemption is available to all resident Florida homeowners. Homesteading is only available for your primary home and you must be a Florida permanent resident. A homestead is restricted to a size of 160 acres outside of a municipality and one-half of an acre within a municipality. The homestead brings with it specific rights these include:

Exemption from forced sale. This exemption prevents forced sale for all debts except property taxes, special assessments, mortgages and vendor or construction liens.
Tax exemption. The current homestead tax exemption is $25,000 of the property's assessed value. See Property Taxes.
Descent of homestead and devise of homestead. These rights protect the family unit and ensure ownership rights transfer to the surviving spouse and children upon the death of a spouse regardless of a will.
